Basic Requirements for Employers
The original employer shall file an application for the part-time jobs of foreign sci-tech talents, and the part-time job employer shall meet the basic requirements for employers applying for a work permit for foreigners in China. Part-time job employers that are subject to pre-approval by industry authorities by laws and regulations shall be approved.
Basic Requirements for Applicants
1. Capable applicants with qualified professional skills or knowledge shall have a clearly-defined employer in China and shall be at least 18 years old in good health and without criminal record.
2. Those applicants shall be foreign sci-tech talents legally working in Shanghai.
3. Those applicants shall engage in urgently needed jobs in China and can make contributions to China’s economic and social development.
4. The laws and regulations which have special provisions, if any, for the employment of foreigners in China shall prevail.

Application Procedure
The original employer shall fill in relevant information on the Service System for Foreigners Working in China (https://kjgl.stcsm.sh.gov.cn/fwps/stcsm/login/loginX.jsp). An Application Form of Part-Time Jobs of Foreign Sci-Tech Talents Working in Shanghai shall be duplex-printed to be signed by the applicant and affixed with the official seals of the original employer and part-time job employer before it is uploaded to the system. There is no need to wait for the results of the preliminary review. The handler shall present the original documents at the reception windows.

Notes
1. For foreign sci-tech talents who legally work in Shanghai to work part time, innovate and start businesses in Shanghai, there is no need to re-apply for or change their work permit. Yet it is necessary to obtain the consent of the original employer and sign a written tripartite agreement with the original employer and the part-time job employer to clarify each party’s rights and obligations.
2. The part-time jobs in Shanghai shall be correlated with the full-time ones.
3. Once an applicant resigns or changes the full-time job, the work permit shall be cancelled and the part-time job shall be rendered invalid.
4. The employers and foreign talents shall ensure the authenticity of the submitted commitments, and cooperate with the approval authorities in interviews and examination for regulation during and after the event. For those who make false commitments, the approval authorities shall have the right to cancel administrative decisions in accordance with the laws, and suspend handling of businesses concerning Foreigner’s Work Permit by employers, agencies, or foreigners. Violations of laws and regulations shall be lawfully dealt with.

2. Online reception
Access to Government Online-Offline Shanghai (http://zwdt.sh.gov.cn/govPortals/index.do) via ECA (electronic certificate authority), switch to the Science and Technology Commission of Shanghai Municipality, click “Foreigner’s Work Permit in China”, then click “Foreigner’s Work Permit in China (>90 days)”, to the Service System for Foreigners Working in China. Or, access to the Service System for Foreigners Working in China directly via Government Online-Offline Shanghai (https://kjgl.stcsm.sh.gov.cn/fwps/stcsm/login/loginX.jsp).
